The following is a listing of significant events regarding the San Gabriel Valley Water Company - Fontana Water
Division General Rate Case Hearings.
- On August 25, 2005 the City of Fontana received great news from the California Public
Utilities Commission (CPUC) regarding the City of Fontana request for a Re-Hearing regarding the last General
Rate Case Application 02-11-044. The CPUC ordered and granted a limited rehearing of their earlier decision
04-07-034.
- On September 6, 2005 the Mayor and City Council requested that a Ad Hoc Sub-Committee
of the City Council be formed to review options regarding the Fontana Water Company General Rate Case application.
- On September 12 , 2005 the City of Fontana filed a formal protest of the newest proposed
General Rate Case application by the Fontana Water Company. The water company is requesting a the following
increases: o 13.1% for 2006 - $5,662,900 o 6.3% for 2007 - $3,072,500 o 4.2% for 2008 - $2,196,000
- On September 13, 2005 the City of Fontana received a copy of the Audit Report by the
CPUC regarding the Fontana Water Company's handling of Ratepayers Funds pursuant to the rules allowed by
the CPUC. The Audit report revealed the following items:
- Fontana Water should allocate $27,456,307 in net proceeds plus interest to ratepayers.
- $2,618,291 of net proceeds should be allocated as Contribution in Aid of Construction.
- The current rate case proceedings should include review to determine the rate making treatment of
416,844,853 excess water contamination proceeds that it received between 1996 and 2004.
- Contamination proceeds should be kept in a Special Bank account to disburse for remediation purposes.
- Fontana Water should adjust its accounting records to reflect reimbursement of Construction Aid
in Capital for $2,618,291.
- Section 790 proceeds received in the future should maintain a memorandum account to track those
proceeds.
- The CPUC should require that all 790 proceeds be deposited in a Special Bank Account that is restricted
to Section 790 investments in plant infrastructure.
- Future sale on condemnations and proceeds from service duplication should seek CPUC approval under
section 851.
- The City of Fontana requested that the CPUC recuse the Administrative Law Judge Patrick on the new General
Rate Case application 05-08-021. This request was granted and a new ALJ has been assigned Judge Burnett.
- On September 22 , 2005 a scoping hearing will be held in San Francisco to discuss
how the rehearing and new rate case will be handled.
- The City of Fontana will be requesting that a Public Participation Hearing be held in the City of Fontana
in the near future to provide public comment regarding services, water rates, and any other concerns the
public has regarding the Fontana Water Company.
